PROPERTY TRANSFERS:  We provide legal services for all kinds of real estate transfers and sales.  Specifically, we represent individuals that are buying or selling a property without a real estate agent for a $4000 flat fee (For Sale By Owner or "FSBO").  We also assist in other transfers of property via grant deed or quit claim deed, typically for trusts or transfers to family members.  We are often called upon to give legal advice regarding property transfer issues or disclosure issues.


REAL ESTATE AGREEMENTS:
 
We draft all sorts of agreements for individuals, couples and groups.  Most agreements involve the joint purchase of real estate, such as a TIC agreement, or deal with property boundaries and permissions, such as an easement. 


REAL ESTATE DISPUTES:  We assist parties with all types of real estate disputes.  We represent buyers, sellers, neighbors, homeowners and contractors.  Whether it is a claim based on a failure to disclose issue, a neighborhood nuisance claim or a breach of contract, our goal is to attempt resolution in the most cost effective manner.  


LANDLORD / TENANT ISSUES:  We represent both landlords and tenants that are in need of general advice or need eviction services or eviction defense assistance. 


LEASES:  We provide drafting and negotiation services for both landlords and tenants that are looking to execute a new lease or revisit an old lease. 


MECHANIC'S LIENS:  We assist both homeowners and contractors in following proper procedures to ensure that their interests are protected.

Conservatorship Sale
Conservatorship sale is a type of real estate sale where the owner is still alive but is mentally no longer able to make her own decisions.  Conservatorship sales are often conducted through the probate court system and either have independent administration or require court approval.  Often a buyer must put 10% down and must buy the home as-is in a conservatorship sale. With a conservatorship sale, there are often very few disclosures or reports provided.

Deed
A document that transfers title to property.  In California, we primarily use grant deeds, quit claim deeds or interspousal transfer deeds.   

Mechanic's Lien
A mechanism to allow a California contractor or other service provider to place a lien on a homeowner's property in order to recoup payment for services rendered.  If done correctly, this process can be very powerful and can allow the service provider to force a sale of the homeowner's property in order to receive compensation for the provided services.  If a homeowner follows proper procedures, a contractor is limited in his ability to file a mechanic's lien.


Probate Sale
Probate sale is a type of real estate sale where the owner has died and did not put the home in a trust.  Much like a conservatorship sale, these probate sales must then be conducted through the probate court system and either have independent administration or require court approval.  Often, with a probate sale, a buyer must put 10% down and must buy the home as-is.  With probate sales, there are often very few disclosures or reports provided.
